1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Peekscribe, including our website, applications, and related services (collectively, the "Service"). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and Account Security
You must be legally able to enter contracts and use the Service in compliance with applicable law. You must provide accurate account information, keep it current, and protect your credentials. You are responsible for all activity under your account, including team member activity and access by anyone using your login details.
3. Service Description
Peekscribe provides content planning, publication workflows, ambassador site operations, and lead-funnel tooling. Features may include AI-assisted idea generation, article drafting, queue scheduling, domain and preview management, lead capture forms, and publishing operations to supported destinations.
4. Roles and Responsibility for Lead Funnel Data
If you use lead funnels or lead capture on your publication, you are responsible for the legality of the campaign, the claims you make, and your communications with respondents. Depending on your configuration and jurisdiction, you may act as the data controller or business for end-user lead data. Peekscribe generally acts as a service provider or processor for that data.
You must publish accurate notices and obtain any consent required by law before collecting or using personal data through funnels, including consent for marketing where required.
5. Customer Compliance Obligations
You agree to comply with all laws applicable to your content, campaign operations, and outreach, including privacy, consumer protection, and anti-spam laws. For commercial email and similar outreach, you must provide legally required sender identification, valid unsubscribe mechanisms, and required postal or contact details, and you must honor opt-out requests within legally required timeframes.
You are responsible for your own legal review of campaign copy, legal notices, consent flow, and regional compliance obligations.
6. AI Features and Editorial Responsibility
The Service may generate AI-assisted outputs, including ideas, outlines, and draft content. AI output can be inaccurate, incomplete, or unsuitable for your context. You are responsible for reviewing all content before publication and for any legal, regulatory, or commercial consequences of publishing it.
7. Subscription Plans, Billing, and Auto-Renewal
Peekscribe is offered as a recurring subscription service with monthly and yearly billing options. Unless otherwise stated in writing, the current standard monthly plan is $39 per month plus applicable taxes. Yearly pricing, where available, is shown at checkout.
By purchasing a subscription, you authorize recurring charges based on your selected billing cadence (monthly or yearly). Your subscription automatically renews for the same billing interval unless canceled before renewal.
Payments are processed by Dodo Payments, a third-party payment processor. You authorize Dodo Payments and Peekscribe to charge your payment method for subscription fees and applicable taxes. We do not store full payment card numbers on Peekscribe systems.
8. Cancellation and Refunds
You can cancel your subscription at any time. Unless required by law or stated otherwise in writing, payments are non-refundable and non-prorated, and cancellation takes effect at the end of the current paid billing period. This means monthly plans remain active through the end of the current month, and yearly plans remain active through the end of the current annual term. You remain responsible for charges incurred before cancellation becomes effective.
9. Domain Registration and Management
If your plan includes domain procurement, you authorize Peekscribe to purchase, configure, and manage domains on your behalf using our selected registrar and DNS infrastructure. For operational reasons, domains may be registered under Peekscribe-managed profiles or registrar configurations controlled by us.
While your account is active and in good standing, we grant you the right to use those domains for the Service. You are responsible for ensuring that requested domain names and related content do not infringe third-party rights, including trademarks and other intellectual property rights.
Domain transfer requests may be supported at our discretion and are subject to registrar rules, technical feasibility, completion of account verification, and payment of any outstanding balances or transfer costs.
10. Content Generation, Approval, and Publishing
The Service may generate and schedule content for your review. You may use manual approval or auto-approve settings where available. You are responsible for final editorial decisions, legal compliance, truthfulness, and publication outcomes for all content published through your account.
11. Your Content and License to Operate the Service
You retain ownership of content and materials you provide to Peekscribe ("Customer Content"). You grant Peekscribe a worldwide, non-exclusive license to host, process, modify, transmit, and display Customer Content only as needed to operate, maintain, secure, and improve the Service.
12. Acceptable Use
You may not use the Service to:
- violate applicable laws or regulations;
- publish unlawful, fraudulent, defamatory, or infringing content;
- distribute malware, spam, or harmful automation;
- attempt unauthorized access to systems, accounts, or data;
- interfere with platform stability, security, or integrity.
13. Third-Party Services
The Service depends on third-party providers, including infrastructure providers, domain registrars, DNS providers, and payment processors such as Dodo Payments. We are not responsible for outages, policy changes, or acts and omissions of third-party services.
14. Intellectual Property
Peekscribe and its underlying software, design, and branding are owned by Peekscribe and protected by applicable intellectual property laws. Except for rights expressly granted in these Terms, no rights are transferred to you.
15. No Legal Advice
Peekscribe does not provide legal advice. Product guidance, template copy, and suggested text are informational only. You are responsible for obtaining legal advice appropriate to your business and jurisdictions.
16. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Peekscribe disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.
17. Limitation of Liability
To the maximum extent permitted by law, Peekscribe will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption. Our aggregate liability for claims arising out of or relating to the Service will not exceed the amount you paid to Peekscribe in the three months before the event giving rise to the claim.
18. Indemnification
You agree to defend, indemnify, and hold harmless Peekscribe from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your domain selections, or your violation of these Terms or applicable law.
19. Suspension and Termination
We may suspend or terminate access to the Service if we reasonably believe there is abuse, security risk, non-payment, legal exposure, or material violation of these Terms. You may stop using the Service at any time. Sections that by nature should survive termination will survive, including payment obligations, limitations of liability, indemnification, and dispute provisions.
20. Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Service after updates become effective constitutes acceptance of the revised Terms.
21. Governing Law and Disputes
Unless applicable law requires otherwise, these Terms are governed by the laws of the jurisdiction where Peekscribe is established, without regard to conflict-of-laws principles. You agree to submit disputes to the competent courts in that jurisdiction.
